The amended Federal Rules of Civil Procedure and emerging case law are forcing attorneys to contend with the complex challenges of electronic discovery (e-discovery). It has become counsels role to guide clients in the preservation and production of electronically stored informatin (ESI) and to oversee the handling and processing of ESI by clients and vendors. This CLE program, which will focus on current law, litigation strategies, and mechanics of the e-discovery process, will provide attorneys with the information needed to comply with evolving rules and standards. |

This presentation will emphasize (although not limited to) issues arising in custody and visitation litigation and is designed to be useful to attorneys who make occasional appearances in Family Court as well as those who regularly appear. Topics include evidence (e.g., out of control court statements of children, contents of business records, use of indicated and unfounded Child Protective investigations), the Court's control of 16 and 17 year olds respecting custody and visitation. We will also have a presentation on the physiology of drug testing, addiction and recovery and the court implications of those processes, and a mock Permanency Hearing. |

Saving Income Taxes-Practical Tax Strategies for your Clients |

This two hour session will review the basics of income tax saving opportunities available under the three types of IRC Section 1031 rollovers/exchanges through the use of a Qualified Intermediary/Exchange Accommodation Titleholder (regular, reverse Starker and the build/rehab to suit formats). In addition, alternative tax strategies to this code section when a client is selling investment or business realty will be summarized. Lastly, practical tax and legal considerations will be discussed when a business is either being acquired or sold. |

People v. Molineaux |

The applicability of People v. Molineaux to contemporary criminal defense practice. In a criminal trial, can the People put in evidence of other crimes committed by your client in their direct case? Should you know the rule in People v. Molineaux, when it has been more than a hundred years since the Court of Appeals decided that case? I do a little bit of criminal work, but I usually plead out most of my cases, because my guy is almost always stone cold guilty - does any of this matter to me at all? The answers to all three questions are, "You bet." Want to know why? Why you need to know these things? Why you shuld consider reading a hundred page case that was decided more than a hundred years ago? If you do any criminal work, this seminar will be a great help. |
